Problems of the criminal law structure of embezzlement

The increase in crime related to embezzlement leads to an increase in poverty and inequality in society, a loss of confidence in the state and law enforcement agencies, as well as a decrease in the standard of living of the population. Some forms of theft are giving way to others, more modern, based on technological breakthroughs, but the essence, legal nature of theft and their forms remain the same, although they are subject to research for the most accurate qualification. In particular, until now, the difficulties in judicial practice are various forms of "telephone" fraud, various types of withdrawals of funds from bank and other accounts of citizens, the level of embezzlement and other forms of abuse of trust is still high. Problems arise in the qualification of embezzlement depending on the method of their commission, the imposition of punishment depending on the severity of the crime, etc. The paper proposes some measures to improve the criminal legislation on liability for embezzlement.
