Problems of legislative regulation of falsification of evidence and results of the ordo (article 303 of the Criminal Code of the Russian Federation)

This scientific article examines the problems of legislative regulation of the composition of the crime provided for in Article 303 of the Criminal Code of the Russian Federation (falsification of evidence and results of operational investigative activities). The current legislation and the practice of its application are analyzed, gaps and contradictions in legal regulation are identified. The article examines the issues of defining the concept and signs of falsification of evidence and the results of the ORDO, the subject and object of the crime, the forms and methods of its commission. Special attention is paid to the qualification of the specified crime, including the separation from related compounds. The authors propose ways to improve legislation aimed at eliminating existing problems and increasing the effectiveness of combating the falsification of evidence and the results of the ORDO. The necessity of making amendments to the Criminal Code of the Russian Federation and the adoption of additional regulations is substantiated.
