Problems of legislative regulation of illegal exemption from criminal liability (article 300 of the Criminal Code of the Russian Federation)

This article is devoted to the study of the problems of legislative regulation of illegal exemption from criminal liability (Article 300 of the Criminal Code of the Russian Federation). Gaps and conflicts in the current legislation are analyzed, examples from judicial practice are given, the causes and conditions of the commission of this crime are revealed. The article suggests ways to improve legislation in the field of illegal exemption from criminal liability, including clarifying the signs of a crime, tightening responsibility for its commission, and increasing the effectiveness of preventive measures. The research is based on the study of normative legal acts, scientific literature and materials of judicial practice. The results of the study can be used to improve legislation and law enforcement practice, as well as to develop measures to prevent this type of crime.
