Legislative regulation problems when applying criminal punishment in the form of correctional labor

The successful implementation of the state concept for the penal system development performs strongly. Despite this fact, the problems resulting from establishing a new state criminal and penitentiary system require prompt and timely solutions in the application of punishments not related to isolation from society, including penalties in the form of correctional labor. In this regard, the research describes the characteristics of modern criminal and penal enforcement policies when applying punishments not related to the isolation of convicts from society. The author reviews the urgent issues of punishment executed in the form of correctional labor and their solutions. The paper examines the difficulties in replacing for correctional labor in case of willful evasion of punishment and discusses a new legislative regulation of the replacement of such punishment. The international practices of solving urgent issues in the field of correctional labor are studied. In addition, it is proposed to create probation services in Penal Enforcement Departments.
