Problems of legislation regulating labor relations of medical workers in the Russian Federation

This article is devoted to topical issues of labor regulation of medical workers in the Russian Federation. Working in the healthcare sector is socially important and requires high qualifications, as medical professionals are responsible for the life and health of patients. In conditions of time constraints and stress faced by doctors, there is a need for a high level of discipline and emotional control, which leads to significant emotional stress and the risk of occupational diseases. The paper examines the problems associated with the lack of elaboration of medical law and the lack of codified acts at the national level, which makes it difficult to resolve labor disputes. As the authors note, despite the significant role of the Labor Code of the Russian Federation, nevertheless, the legal norms governing the work of medical workers are also contained in resolutions of the Government of the Russian Federation and orders of the Ministry of Health of the Russian Federation, which creates a complex and deeply branched system of regulatory legal acts. It is emphasized that it is necessary to approve uniform standards regarding the volume of work, standards for workload broken down by each specialty, as well as to provide for the responsibility of employers for violations of these standards. The importance of such a measure cannot be overestimated, since excessive workload of medical personnel leads to reduced attention, overwork, and increases the likelihood of errors. According to the authors, issues of the quality of medical care require the introduction of a unified procedure for investigating a patient’s claim to a medical institution at the legislative level, which should include the principle of forming an expert commission, its powers (access to documents representing medical secrecy), and an assessment of the activities of medical personnel.
