The article analyzes the procedural features of the bankruptcy institution, which are caused by the clash between the private interests of the parties involved and the public interest in maintaining economic stability. The article examines the legality and proportionality of restrictions on the procedural rights of the debtor and creditors in order to ensure the speed and efficiency of the procedures. Special attention is paid to the analysis of the role of the bankruptcy trustee and the court in the context of the principle of adversarial proceedings, and the article justifies their active role as a necessary condition for resolving this conflict of interests.
