The procedural procedure for invalidating a will drawn up by a person who is unable to understand the meaning of his actions

The purpose of the article was to investigate the procedural procedure for declaring a will invalid by a court of general jurisdiction. The plaintiff's appeal to the court in cases of invalidation of the will is possible on various grounds related to both violation of the form of the will and other grounds related to its fictitiousness, misleading the testator or even the testator's inability to understand the meaning of his actions, the latter reason will be investigated in this article. On this basis, the recognition of a will as invalid has its own special subject of proof and a list of proofs. In this regard, it was necessary to get acquainted with the procedural procedure for filing a statement of claim in a case of contesting a will, to consider in detail the process of proving and considering the case by the court, the composition of the persons involved in the case.
