Investigation of production accidents: features of application of new rules

Legislation in the field of labor protection, including the procedure for investigating accidents at work, is constantly changing. Thus, on September 1, 2022, Order of the Ministry of Labor of Russia dated April 20, 2022 No. 223n “On the specifics of the investigation of industrial accidents in certain industries and organizations and the forms of documents required for the investigation and recording of industrial accidents” (hereinafter referred to as the Regulations) came into force. The Ministry of Labor has significantly updated the rules and forms of documents that all employers are required to use when investigating industrial accidents. The new document excludes repetition of the basic principles of accident investigation, terms and criteria for classifying an industrial injury. These changes were made within the framework of the regulatory guillotine, in order to avoid duplication of information contained in Articles 227-231 of the Labor Code of the Russian Federation (hereinafter referred to as the Labor Code of the Russian Federation). The changes made are aimed at improving legislation in the field of labor protection. The article reflects the main features of the procedure for investigating industrial accidents in accordance with the new Regulations.
