Development of the institute of proving in historical retrospect and its modern importance in civil procedure

The institute of proving is one of the most important elements underlying the timely and competent consideration of civil cases in order to make a fair and lawful judgement on them. The article analyses various approaches of scientists to the definition of the concept of ‘proving’, its structure and content. Scientific points of view regarding the historical formation and subsequent development of the institute of proving are given. As a result, imperfections in the regulation of the institute of proving in the current civil law legislation are revealed. It is concluded that it is necessary to introduce the concept of ‘proving’ in the Civil Procedure Code, which will contribute to a clearer regulation of this institute.
