Development of systemic legal knowledge in contemporary methodology

Introduction: the article considers manifestation of systemic legal knowledge development in contemporary methodology. Purpose: the aim of the article is to give a complex idea of the development of systemic legal knowledge in contemporary methodology, which entails the following objectives: identification of the links between the category of “systemic legal knowledge” and basic components of jurisprudence; analysis of main methods and methodological approaches aimed at production of systemic legal knowledge. Methods: methodological basis of cognition is defined by the dialectical approach to research on social reality, including law. In the study we use general scientific methods (analysis, synthesis, induction and deduction, abstraction, etc.) and specific scientific methods (comparative legal method and legal technical method). The article contains direct analysis of the methods and approaches to law that comprise contemporary legal methodology. Conclusions: awareness of various approaches to understanding law is an important element in the structure of formation of systemic legal knowledge. When considering the development of methodology of systemic cognition of law, it is important to understand that systemic nature of law does not deny existence of any approaches to legal consciousness. Study of the “systemic legal knowledge” category must be conducted not only at the level of legal science methodology, but also at that of general methodology. Systemic, complex and interdisciplinary approaches to cognition of legal matter reflect different degrees of systemic quality of law and legal methodology. The interdisciplinary approach along with the dialectical approach, systemic structured method, synergetic and cybernetic methods makes it possible to capture tendencies in the development of law and its potential alternations (vectors of legal dynamics), which appear at the intersection of quite difficult but urgent issues. In the article we disclose interaction of summative and organic systems of law through the prism of legal methodology and the role of scientific cognition in the change of legal reality. The article includes analysis of certain types of legal bonds, in the context of bond analysis main characteristics of legal comparative methodology are given. Taking into account the potential of comparative law, which appears at different levels of legal system analysis, this field of study enriches the development of systemic legal knowledge.
