This paper deals with the importance of the adversarial principle in the arbitration process, which has its own characteristics: it comes from the equal opportunities of the parties to present evidence to the court and participate in the evidentiary process, conducting research on evidence and expressing their opinion on the subject of the dispute. With the help of various arguments and evidence, the parties convince the court of the correctness of their position. Among the disputes considered by arbitration courts, bankruptcy cases belong to one of the most complex and at the same time interesting categories. At the same time, the article notes the application of the adversarial principle in this category of cases.
