The study describes recidivism as a social phenomenon. In addition to the typical characteristics of a crime, the author notes the recurrence of an offense as a result of ineffective sentences and their improper execution. At the same time, this phenomenon is determined by the important social factors such as desocialization in places of detention. The study reveals the main problems conducive to the rise in recidivism in society because of ineffective Russian punishment system. The research describes such aspects as the social status of people released from prison; the lack of state social rehabilitation program; the ambiguous attitude of society towards severe criminals; the desire of society to solve the problem of recidivism by increased punishment. The author concludes that there is no connection between the smooth functioning of the sentence system strived to attain the main goal, i.e. punish an offender, and its effect on the re-education of a perpetrator. Recidivism seems to be a consequence of this situation.
