The regional system of public security (on the example of Perm krai)

The article analyzes the example of the Perm region base edition of the laws of the Russian Federation in the field of public safety. In accordance with Art. 72 and 76 of the Constitution of the Russian Federation we propose to develop the law of administrative rules of the Perm region for ensuring public safety, set the legal basis for the creation and operation of a regional system of government bodies and local self-government that define administrative powers to ensure public safety. In the structure of the regional system of administrative law of the public safety, we propose to allocate powers, administrative and legal means to ensure public safety, as well as non-state system of public security, consisting of citizens empowered to participate in the protection of public order. Drawing on the concept of public security, as well as analysis of other legal acts establishing the competence of the Russian Federation, we define in the article the purpose and the list of basic functions of a regional system of public security. From the total number of problems of legal regulation of regional public safety systems we enlist the following: the lack of a clear understanding of the term "law of the Russian Federation in the field of security"; mismatch of the boundaries of administrative offenses against public safety, the law outlined in the Code of Administrative Offences, with boundaries of preventing offenses which outlined the concept of public security in the Russian Federation. With the absence of norms inside the applicable federal laws of the mechanism of interaction of subjects of state authority of the Russian Federation with the territorial subjects of federal executive bodies, vested administrative authority to ensure public safety. There are significant difficulties in developing a mechanism for empowering local government administrative powers to ensure public safety, inevitable difficulties of regional legal regulation of participation of citizens and organizations in the activities of public security.
