The analysis of social and economic consequences of defaults of borrowers on the mortgage housing loans is provided in work, the main reasons for emergence of defaults of the Russian mortgage borrowers and ways of their prevention are allocated, the system analysis of need is provided and the consequences of granting the right for restructuring and refusal in it are assessed. The basic principles of effective state policy on realization of the right of the borrower for restructuring taking into account maintaining balance of interests of the borrower and the creditor are proved.
