The role of the prosecutor in imposing a penalty in the form of a court fine

The article deals with the relationship between the powers of the Prosecutor, the investigator and the head of the investigative body in the proceedings on the application of a court fine. The authors criticize the provisions of the criminal procedure law, which do not allow the prosecutor to approve the investigator’s decision to dismiss the case and to send a petition to the court for the application of a judicial fine. The necessity of approval by the attorney specified the final procedural act in order to prevent illegal actions on the part of the investigating authorities.
