Unauthorized construction as the basis for acquiring property rights: problem aspects

The article reveals the unauthorized construction as a way of acquiring property rights. The author gives examples of various court decisions on the issue of unauthorized construction, considers scientific views on the essence of unauthorized construction as the basis of property rights. The scientific novelty of the article is the disclosure of the scientific content of unauthorized construction as a real estate object and a special type of creation of a new thing as a way of acquiring ownership. The object of the research is social relations in the field of property rights. The subject of the study is the rules of civil law governing the grounds for the acquisition of property rights. The study used formal-legal, dialectical method of research, as well as a group of general scientific methods: analysis, synthesis, induction, deduction. The author supports the idea that unauthorized construction is a special kind of method of acquisition of property right in the form of creation of a new thing (real estate).
