The activity of investigating crimes is always of a public nature, since it is aimed at protecting the rights and legitimate interests of both a particular victim and society as a whole. At the same time, as part of the investigation, activities are often carried out that aim to complicate the proof of the guilt of a person prosecuted, since if a court imposes a punishment for a crime, it entails certain negative consequences for the guilty person. The desire to avoid these consequences in full or mitigate these consequences gives rise to the desire to counteract the investigation of a crime, including in the form of abuse of the right. Investigative actions are the most effective means not only to identify all the circumstances of the crime committed, but also to overcome opposition to the investigation.
