«Investigative» experiments and tests in criminal proceedings: issues of normative regulation and law enforcement practice

Бесплатный доступ

The article analyzes the problems arising in the normative regulation and practice of the so-called judicial (investigative) experiments, that is cognitive-verification techniques, which boil down to conducting various experiments and tests in the course of the judicial investigation, which help establish circumstances that are significant for the criminal case and substantiate sentences or other law enforcement acts. Suggestions are made on the advisability of eliminating existing shortcomings not by amending the criminal procedure legislation, but by means of appropriate doctrinal and methodological support for judicial, prosecutor’s and advocate’s activities.
