This study deals with the specificity of sociological research in the field of intellectual property, which help to analyze the presence or absence of the distinctiveness for means of individualization acquired in the course of use. The operationalization of the term reveals the features of the formulation of questions and the necessary set of indicators that allow us to conclude that the means of individualization have acquired a distinctive ability. On the basis of data obtained on the surveys, the author explains the approach to selecting research methods and design tools tailored to the industry and theme. The increasing dynamics of the use of opinion polls as evidence in disputes related to intellectual property stimulates research to improve the methodology and quality of questionnaires presented to consumers-respondents, as well as in the wording of questions and response options on the main indicators that reveal the subject.
