Improvement of procedure for the gathering of evidence contained in data networking systems

This article examines questions related to the weakness of legal regulatory framework of procedure of receiving the evidence on electronic media. The approaches of various authors to the need for improving of procedure of the gathering evidence on electronic media are analyzed. In order to strengthen the understanding by law and to determine the conditions and order of new investigation proceedings the author proposes to make changes in the current Code of Criminal Procedure of Russia.
