Current problems of operative investigative activities in the context of compliance with the constitutional rights of citizens

The article considers the correlation of operative investigative activities and observance of human rights and freedoms in the implementation of operative investigative activities. With the development of the rule of law and the legal system based on democratic principles, there emerged an objective need for the guarantees of observance of the fundamental human rights and freedoms. Therefore, currently the operative investigative activities are based on legislative framework and generally recognized constitutional provisions that regulate and guarantee the observance of human rights and freedoms. Based on the foregoing, we have come to the conclusion that safeguards for the citizen's rights and freedoms in operative investigative activities should be a priority in the context of using special forces and means to combat crime, obtaining information about events or actions that pose a threat to the state, military, economic and environmental security of the Russian Federation.
