The article presents a comparative legal analysis of the criminal legislation. The authors discuss existing national models, which consider the factor of murderer's knowledge of helpless condition of a victim. The authors believe that the most effective is the approach reflected in the latest version of the Criminal Code of Germany, which interprets helpless person as any healthy adults who turn out to be helpless in a particular situation.
