Standards of proof in the practice of courts of general jurisdiction of the fourth cassation district

The practice of the Judicial Board for Economic Disputes of the Supreme Court of the Russian Federation, which has developed over the past few years, has introduced a new term into the Russian legal system - “standard of proof”. Modern conditions of legal proceedings dictate the urgent need for the practice of applying standards of proof to go beyond disputes burdened with a bankrupt element and its extension to courts of general jurisdiction. The article considers some practical aspects of the use of various standards of proof by the courts of general jurisdiction of the Fourth Cassation District. The value of the study lies in the fact that it focuses on the legal positions formulated by the courts of one district, and reflects the current trends of the courts in this aspect. The authors substantiate the need to form a uniform legal position on the application of standards of proof by courts of general jurisdiction, generalization of judicial practice by the Fourth Court of Cassation.
