The article draws attention to the relationship between subjective right and legitimateinterest. The similarities and differences between these concepts are identified, and issues that arise inthe process of their correlation and implementation are considered. Methods for realizing subjectiverights and legitimate interests are proposed based on the principle of competition and the institution ofappeal. The development of the principle of competition and the institution of appeal will give citizensthe opportunity to protect their subjective rights and legitimate interests in full. Goal. To propose legislative innovations necessary for the implementation of rights and legitimateinterests in criminal proceedings. Methodology. The conclusions are based on the comparative legal method and analysis of legislation.The systemic-structural method was used to identify connections and dependencies between thecategories under study.
