The phenomenon of judicial lawmaking in the Soviet period of the development of Russian law is analyzed in the article. The author provides analysis of the relevant legislation and scientific literature, and formulates the conclusion about the existence in the Soviet period of prerequisites for recognizing the phenomenon of judicial lawmaking as a full-fledged legal source. Special attention is paid to the analysis of the activities of the Supreme Court of the USSR, which consisted in issuing guidelines and monitoring their implementation by lower courts. The relevance of the work is determined by the continuity between the Soviet and modern Russian judicial systems, which makes it possible to enrich the scientific understanding of the role of judicial lawmaking in the domestic legal system.
