Judicial discretion as a method of precept of the law uncertainty compensation (on the example of dealing with the problem of cost compensation of payment for services provided by the representative in the arbitration court)

The article deals with the problems concerning the cost compensation of payment for services provided by the representative in the arbitration court. Due to absence of well-defined legal control of the compensation of expenses procedure for the winning party, the author pays special attention to the rationality and adequacy criteria concerning remuneration of the winning party representative. Till the uncertainty of the normative precept is controlled, applying a judicial discretion can be a way for solving the problem.
