The article is devoted to the issues of the essence of ensuring the constitutional rights and freedoms of man and citizen in the implementation of operational-search activities. The author comes to the conclusion that carrying out ORM, limiting the constitutional rights of citizens, is an effective measure to combat crime. However, during their implementation, some difficulties often arise related to the legality of their implementation, as well as the subsequent effective use as evidence in a criminal case.
