The article is dedicated to the definition and study of the problem of "conflict of laws", the primary qualification of conflicting standards in private international law. The article examines in detail the essence of a legal relationship complicated by a foreign element, its difference from other legal relations, whether the presence of a foreign element in a legal relationship means the automatic use of foreign law to resolve a dispute. The concept, structure and functions of conflicting standards in private international law, ways and approaches to its interpretation in practice. A widespread analysis of the problem of primary qualifications is carried out, as well as the main controversial issues that exist in the doctrine of private international law.
