The article summarizes jurisprudence on errors in sentencing. The role of the public prosecutor in the choice of sentencing in the form of restriction of liberty is studied, the statistics of sentencing in the form of restriction of liberty in comparison with deprivation of liberty and the suspended term of sentencing for the period from 2007 to the 2019 are analyzed across all Russia.
