Criminal characterisation of failure to provide assistance: an overview

In the course of this work it was determined whether or not a person who passes by a person who is in a life- or health-threatening situation, while not bound to the latter by certain obligations and having the opportunity to take any action to preserve the viability of such a citizen, is the subject of a crime under Article 125 of the Criminal Code “Abandonment in danger”. It has also been found that in such a case the rights to life and health of the person in need of assistance would be violated. Consequently, the provisions of this norm in the current criminal legislation of the Russian Federation need to be amended in order to eliminate a gap in it, manifested in the inability of the criminal law norm to protect the existing social relations.
