In the article author attempted to reveal conditions of using the action of declaration of property rights of the constructed object by developer in his bankruptcy process. It is not common to use the action of declaration of property rights of the constructed objects in developer`s bankruptcy processes. In the same time in developer`s bankruptcy processes there are cases when the only property developer has is unfinished object, recognized as a real estate. Research into a designated topic is necessary not just because of theoretical needs but aiming to increase the number of bankruptcy cases satisfying claims of the debtor.
