Conditions taken into account when imposing administrative punishment

The article describes mitigating and aggravating circumstances that are taken into account when imposing administrative punishment, which allows for individualising the responsibility of the offender and imposing a punishment that is proportionate to the offence committed. The authors note that aggravating circumstances have a clearly defined list, which is enshrined in law in the CAO RF. Mitigating circumstances are also listed in the CAO RF, but the judge, body or official involved in the consideration of an administrative offence case has the right to recognise other circumstances as mitigating. It is concluded that the general rules on the imposition of administrative punishment are directly related to the principles of their imposition.
