Establishing the credibility of evidence in a civil case in the context of the development and adoption of the concept of the unified Civil Procedure Code of the Russian Federation

The research analyzes the competing provisions of Article 186 of the Civil Procedure Code of the Russian Federation and Article 161 of the Arbitration Procedure Code of the Russian Federation while developing and adopting the Concept of the Unified Civil Procedure Code of the Russian Federation. The study demonstrates the correlation between such concepts as fraudulence and falsification of evidence in a civil case. The author conducts a comparative analysis of the procedure (set forth in the provisions of the above-mentioned codes) for accepting and considering an application to verify the credibility of evidence in civil proceedings. Based on the doctrine and case law, the researcher draws a conclusion related to the court’s duties and rights to check the reliability of evidence. The proposals have been put forward to unify the rules of validation of evidence and their introduction into the Unified Civil Procedure Code of the Russian Federation.
