Issues of storage of judicial cases at the stage of their consideration or gaps in the legislation on judicial proceedings

This article considers the issue of storing cases at the stage of their consideration, which is not regulated by the legislation on judicial record keeping, i.e. from the moment of receipt (distribution) to the judge until it is handed over to the judicial record keeping department upon completion of consideration. The author tries to understand the reasons for such a gap in the legislation, and also discusses the consequences of the unresolved issue of the order of the content of cases until their resolution, its impact on the principles of dispositivity and openness of justice. The article contains conclusions and suggestions on the need to legislate in regulatory legal acts, as well as in the Instructions for Judicial record keeping, the procedure for storing cases at the stage of their consideration.
