The authors attempted to reveal the theoretical and normative aspects of the use of the category "age" as a legal fact in labor relations and relations directly associated with them, to determine its place among other legal facts, and to identify the specifics of using age for certain categories of employees. The work raises some issues of discrimination against employees of pre-retirement and retirement age. Besides, the authors substantiate the need for the legislator to devel-op and consolidate measures to protect such employees.
