Revealing a lie in court

Introduction. One of the peculiarities of any legal proceedings, including arbitration proceedings, is personal participation of different subjects who give evidence in court. The judge basing on his/her own experience and knowledge must estimate the testimony given by the plaintiff, defendant, witnesses, specialists, etc. not only in regard to its importance as proof but also concerning its reliability and validity. Materials, Results and Discussion. The attempted research proves that the legal proceedings participants not infrequently give false information while it is not always possible for the judge to reveal it, which negatively influences administration of justice. Examining various manifestations of lie the author makes the conclusion about the usage of its three main forms: active, passive and active-passive. As for the stress as a consequence of the liar’s awareness of his unlawful actions, the author reveals its forms. The article presents different external signs, knowing them helps to identify a liar in legal proceedings and administer justice. Conclusions. The research conducted shows that manifestation of a lie rather often takes place in obtaining or estimating personal evidence in court during the direct contact with the data possessor (plaintiff, defendant, witnesses, specialists, translator, etc.)
