Detection of entrapment in operational-search and criminal-procedural activity based on the experience of the European Court of Human Rights

The article is devoted to the problem of detection and prevention of entrapment in the course of operational and investigative actions, such as controlled buy and operational experiment, which is topical in modern operational-investigative and criminal-procedural activities. The author considers the definition of the term "provocation (entrapment)" presented by the European Court of Human Rights. Based on the analysis of the recommendations of the European Court of Human Rights the author identifies the main requirements for carrying out operational investigative measures that allow to distinguish the legitimate actions of operational staff from the entrapment.
