Deepfake как инструмент преступного воздействия: криминологические риски и модели правового регулирования

В статье рассматривается проблема роста преступлений и правонарушений, совершаемых с использованием технологий искусственного интеллекта (далее — ИИ), в частности технологии синтеза изображения и голоса Deepfake. На основе анализа зарубежного опыта государств Азиатско-Тихоокеанского региона, Европейского союза, США, Китая, Республики Корея и Российской Федерации показана динамика и структура киберпреступлений, связанных с использованием дипфейков, рассмотрены основные модели правового регулирования данной сферы. Отдельное внимание уделено ситуации в Республике Узбекистан, где фиксируются первые случаи использования дипфейков в мошеннических целях. По итогам анализа предложен комплекс организационно-правовых мер по раннему предупреждению соответствующих преступлений.

Deepfakes as a Criminal Instrument: Criminological Risks and Legal Regulation Models
This article examines the growing number of crimes and offenses committed using artificial intelligence (hereinafter referred to as AI), in particular, deepfake image and voice synthesis technology. Based on an analysis of international experience in the Asia-Pacific region, the European Union, the United States, China, the Republic of Korea, and the Russian Federation, the dynamics and structure of cybercrimes related to the use of deepfakes are demonstrated and the main legal regulation models for this area are discussed. Particular attention is given to the situation in the Republic of Uzbekistan, where the first cases of deepfakes being used for fraudulent purposes are being recorded. Based on the analysis, a set of organizational and legal measures for the early prevention of these crimes is proposed.
