The phenomenon of the "vicious inward nature" of human in the context of crime and punishment

In this article the author examines the connection between the evil and crime, showing that it is always worried criminologists, psychologists and philosophers. In this case, as shown in the article, in the context of ethics, this issue gets the depth and dimensionality, making problems of the possibility of an adequate and just punishment. Considering the views of various philosophers and psychologists, the author reveals the phenomenon of the “vicious inward nature” of human, which is largely irrational. Comparing different approaches to the phenomenon of the “vicious inward nature” of human, the author concludes that the Russian philosophical tradition is of particular strength and depth as the evil here is associated with death and mortality. The author offers his vision of problems, according to which absolutization of the “vicious inward nature” of human leads to a distorted view of human nature. At the same time ignoring the phenomenon turns complacent conceptions of man. Fundamental asymmetry of moral consciousness is such that does not allow to talk about evil or good about human nature finally, in unequivocal terms, that actualized the problem of moral choice, based on open and morally free human nature. This moral argument is particularly important when it comes to the legal assessment of the crimes.
