Guarantees of the principle of presumption of innocence

The implementation of the principle of presumption of innocence requires certain guarantees of justice and protection of the rights of the accused, which allows to prevent erroneous sentences and unfair charges. The article considers the features of classification of guarantees of presumption of innocence based on their division into material (status, law) and procedural (rules of procedure). Legislative norms and examples of their implementation in judicial practice are given. It is concluded that having different contents, these guarantees are inseparable and form a single whole and ensure the fairness and legality of modern Russian judicial proceedings.
