Paradoxically, Law No. 20 05, Algeria's legislative attempt to combat hate speech and discrimination, includes cla uses that allow for differential treatment under certain circumstances, resulting in a complicated legal enviro n- ment where equality and legitimate discrimination coexist. A wider understanding of international law that not all distinctions amount to illega l discrimination is reflected in these exceptions, which are based on the pursuit of justifiable goals and proportionate means. The legalization of justified discrimination acknowledges that in some situations, treating everyone the same way may reinforce or worsen already existing disparities. This sophisticated approach aims to strike a compromise between the practical necessity to address particular societal issues and advance substantive equality and the broader principle of non discrimination. Althoug h equality of opportunity is a key component of anti discrimination initiatives, it recognizes that attaining true equality may call for short term or focused policies that discriminate against particular groups. A detailed analysis of the legal and social structures that allow for differentiated treatment is necessary to comprehend the subtleties of justified discrimination.
