There is no unity in legal science in understanding the place of the President of the Russian Federation in the state mechanism. In modern science, the prevailing opinion is that the President of the Russian Federation is not a member of any of the branches of government. An analysis of the mechanism of interaction between the head of state and the bodies of the branches of government allowed us to conclude that the head of state is a member of the executive branch of government of the Russian Federation. The special status of the head of state is determined by his strong position in the system of checks and balances in relation to the State Duma, this is due to the political factors under which the current Constitution was adopted. It is proposed to secure the place of the President of the Russian Federation in the executive branch at the constitutional level. The position of the President of the Russian Federation in the judicial branch has been strengthened, which may lead to a violation of the principle of separation of powers. It is proposed to include representatives of the judicial community in the mechanism of early retirement of judges, as well as to restore the mechanism of election of the Chairman of the Constitutional Court of the Russian Federation by judges of the Court by voting, which will resolve this problem. In conclusion, it is concluded that the status of the head of state is a dynamic structure, the elements of which are constantly evolving. It is obvious that the priority of certain elements of this structure is determined by the goals and objectives of the state, its form of government, political regime, arising at a certain stage of its historical development. The legislator should monitor and make adjustments to the structure of the status of the head of state.
