On interaction of part 6 of article 15 and part 3 of article 64 of the Criminal Code of the Russian Federation

This scientific article is devoted to the study of the operation of the norm on changing the category of a crime in cooperation with the institution of assigning a softer punishment than is provided for this crime. It is pointed out that the existence of these norms in the Criminal Code of the Russian Federation entails difficulties in law enforcement and creates a situation when for the commission of crimes specified in part 3 of Article 64 of the Criminal Code of the Russian Federation, there is a small, but nevertheless, the possibility of receiving less punishment and a smaller amount of criminal legal consequences within the framework of the rule on changing the category of crime.
