Ensuring confidentiality in the context of a gap in the institution of investigative actions

At the moment, the institution of investigative actions is undergoing significant legislative changes, the practical need to fill the gaps and adaptation in the light of digitalization and merging with operational-search prototypes of information collection methods. At the same time, there is an increasing number of violations in the course of investigative actions guaranteed by the Constitution of the Russian Federation of the rights and freedoms of citizens. The current study analyzes the general nature of the gaps in the regulatory regulation of the institution of investigative actions in order to assess the possibility of entering this system of means of criminal procedure with a confidential basis and the basic conditions for ensuring the secrecy of the results of investigative actions. It is proposed to streamline the rules on investigative actions and rules (conditions) of their production in a separate chapter as a starting mechanism.
