Justification and Legality of Procedural Decisions by Officials in Pre-Trial Proceedings

The article examines the problem of ensuring the principle of reasonableness of procedural decisions in pre-trial proceedings based on an interdisciplinary approach that includes provisions of management theory and psychology. The analysis shows that, under the influence of a bunch of external and internal factors, the logical connection between procedural decisions gets messed up, turning into interdependence, where later decisions are made to back up earlier decisions and conclusions. Particular attention is paid to the problem of the lack of a clear mechanism in the law for recording the investigator’s internal conviction, which prevents a full assessment of the evidence and arguments of the defence. As a result of the study, the reasons distorting the interconnection of decisions were identified and ways to solve the problem were proposed.
