В статье исследуется советский арбитражный процесс в 1946–1953 гг. Цель – выявить достоинства и недостатки в судебной работе Государственного арбитража при СНК/СМ СССР (далее – Госарбитраж СССР). Методологической основой исследования являются общенаучные методы познания (индукция, дедукция, синтез, аналогия), в том числе историкоправовой и системный методы. В науке данный период судебной работы Госарбитража СССР является малоизученным. Отличием данной статьи от ряда других работ является рассмотрение арбитражного процесса с учетом содержания архивных дел разных фондов. Автором проанализировано состояние арбитражного процесса с 1946. по 1953 гг., где отмечается общая негативная ситуация в отдельных направлениях его работы. В заключении указывается, что Госарбитраж СССР с учетом большого количества рассматриваемых дел и относительно низкого процента обжалуемых решений справлялся со своей задачей. При этом имелись отдельные недостатки при подготовке дел к слушанию, в скорости рассмотрения споров, качестве выносимых решений, допуске в арбитражный процесс представителей сторон не из числа руководящих работников организаций.

General characteristics of the judicial process in the USSR state arbitration in 1946-1953

The article examines the Soviet arbitration process in 1946–1953. The purpose is to identify the advantages and disadvantages in the judicial work of the State Arbitration Court under the Council of People's Commissars of the USSR (hereinafter referred to as the USSR State Arbitration Court). The methodological basis of the research is general scientific methods of cognition (induction, deduction, synthesis, analogy), including historical, legal and systemic methods. In science, this period of judicial work of the USSR State Arbitration Court is poorly studied. The difference between this article and a number of other papers is the consideration of the arbitration process, taking into account the content of the arbitration cases of different funds. The author analyzes the state of the arbitration process from 1946 to 1953, where there is a general negative situation in certain areas of his work. In conclusion, it is indicated that the USSR State Arbitration Board, taking into account the large number of cases under consideration and the relatively low percentage of decisions appealed, coped with its task. At the same time, there were some shortcomings in the preparation of cases for hearing, the speed of dispute resolution, the quality of decisions made, and the admission to the arbitration process of representatives of the parties not from among the top employees of organizations.
