Legal regulation of marriage and family relations in the culture of the Russian people in the patriotic historiography of the 2nd half of the XIX century

The relevance is due to the need for a comprehensive study of the formation and evolution of the cus-tomary law of Russian peasants in the field of marriage and family relations, because family is the primary social cell, the basis of Russian society. The scientific novelty of the topic is in need of understanding the Genesis of problems of legal regulation of marriage and family relations. The retrospective analysis will not just allow developing a valid mechanism for solving problems of legal regulation of relations in the sphere of family and marriage in modern conditions, but warn against mistakes and errors that occurred in the historical past. The aim of this work is to study the legal regulation of marriage and family relations of the Russian peasantry in the context of the evolution of legal, political, cultural, and economic systems of Russia. The author uses such materials and methods as the classification and analysis of historiographical sources, including the work of professional scientists in the field of history of Russian law. The methodological basis is the scientific principles of objectivism, systematic, problem-chronological and comparative approach. The result of the work identify and compile specifically legal and theoretical achievements and challenges in the study of the family relations of the Russian peasantry in Russian historiography the period specified.
