Правовые механизмы стимулирования развития зеленых виртуальных активов в странах БРИКС

Статья посвящена анализу подходов стран БРИКС к решению проблемы правового стимулирования цифровых активов через введение стандарта зеленых криптовалют. Основным методом исследования является межотраслевой подход, когда решение проблемы находится во взаимодействии и взаимосвязи гражданского права и экологического права. Исследуется вопрос о перспективах формирования эко-подходов стран участников в части изменений производства криптовалют путем замены энергозатратного механизма Proof-of-Work на более эффективный механизм Proof-of-Stake с учетом правовых возможностей каждого субъекта. Дается оценка действующим национальным нормативным правовым актам в сфере криптоиндустрии, а также готовности действующего законодательства адаптироваться под текущие реалии с целью минимизации последствий добычи криптовалют для экологической среды. Проводится систематизация текущих правовых инициатив и определяются стадии работы в сфере нормативного регулирования экологического майнинга криптовалют в странах – участниках БРИКС (Бразилии, России, Индии, Китая и ЮАР). Сделан вы-вод о наличии дефицита специализированных правовых механизмов для развития зеленых криптовалют, предлагаются способы унификации регулирования, в том числе путем определения места зеленых криптовалют в системе объектов гражданского права.

Legal mechanisms to stimulate the development of green virtual assets in the BRICS countries

The article analyzes the approaches of the BRICS countries to solving the problem of legal incentives for digital assets through the introduction of a standard for green cryptocurrencies. The main research method is an interdisciplinary approach, when the solution to the problem is in the interaction and interrelation of civil law and environmental law. The article examines the prospects for the formation of eco-approaches of the participating countries in terms of changes in the production of cryptocurrencies by replacing the energy-intensive Proof-of-Work mechanism with a more effective Proof-of-Stake mechanism, taking into account the legal capabilities of each entity. An assessment is given of the current national regulatory legal acts in the field of the crypto indus-try, as well as the readiness of the current legislation to adapt to current realities in order to minimize the consequences of mining cryptocurrencies for the environmental environment. Current legal initiatives are being systematized and the stages of work in the field of regulatory regulation of eco-logical mining of cryptocurrencies in the BRICS member countries (Brazil, Russia, India, China and South Africa) are being determined. It is concluded that there is a shortage of specialized legal mechanisms for the development of green cryptocurrencies, and ways to unify regulation are proposed, including by determining the place of green cryptocurrencies in the system of objects of civil law.
