Implementation of the international procedural principle of estoppel in the Russian civil procedure process

Free access

The article analyzes the possibility of applying the international legal procedural principle of estoppel in the Russian civil procedure process, as a result of which the author concludes that it is possible to apply it despite the fact that the estoppel principle was originally developed within the framework of Anglo-Saxon law as a mechanism to counter unfair behavior of a party to a legal dispute. The normative consolidation of procedural estoppel in Russian procedural legislation would allow the courts to apply the already existing norms contained in paragraph 2 part 1 of Article 127.1 of the APC of the Russian Federation and Part 2 of Article 209 of the CPC of the Russian Federation.
