В данной части работы с использованием метода моделирования исследуется возможность введения в правовую систему Российской Федерации института следственного судьи с наделением последнего функциями судебного контроля процессуальных и следственных действий, рассмотрения жалоб на действия органов расследования в области уголовного процесса, а также санкционирования оперативно-розыскных мероприятий и иных действий, ограничивающих конституционные права граждан, проводимых органами, осуществляющими оперативно-розыскную деятельность, и рассмотрение жалоб на их действия. Изучению подвергнуты организационный и деятельностный элементы модели. Автор приводит аргументы необходимости введения изучаемого института в правовую систему страны.

The investigating judge as a necessary component of the mechanism for ensuring the legality of operational investigative activities (part two: organizational and operational elements of the institution’s model)

In this part of the study, the possibility of introducing the institution of an investigative judge into the legal system of the Russian Federation is studied using the method of modeling. The investigative judge will be vested with the functions of judicial oversight of procedural and investigative actions, consideration of complaints on the actions of investigative bodies in the field of criminal procedure, as well as the authorization of operational and investigative activities and other actions that restrict the constitutional rights of citizens carried out by the bodies conducting operational and investigative activities, and the consideration of complaints on their actions. The organizational and operational elements of the model are studied. The author provides arguments for the necessity to introduce the institution under the study into the country’s legal system.
